I received an email today offering to sell me a spam mailing list.

Would you be interested in acquiring a mailing list for your company marketing use?

"Case dismissed"

Well, the court case with Communicado happened on Monday and it went pretty much as expected.
Essentially the judge dismissed the claim because there were no quantifiable damages.
The time spent dealing with the spam and the money we spend on services to protect ourselves do not count as "damages" and so are not able to be claimed.

"I support marriage equality" Do you really?

This morning, someone I knew decided to share an image about marriage equality and I made a comment that it was missing a poly marriage (he was after all advocating equal marriage) to which he replied:
"True but if you say that then you would be saying that a guy or girl marring(sic) an animal should be"

Spam update and a payment!

A few week ago, I finally received a court date for my hearing with Communicado Ltd for the 3rd of February.

Communicado court case update

It's now been 7 weeks since I asked for a judgement, and 11 weeks since I filed a claim, I've had a sum total of 3 letters, 2 saying it's being transferred to Canterbury county court (their home court, normal for small claims) and another today saying it's been transferred back to my home court!
I'm still yet to hear or find out if they've actually filed a defence yet.

Requesting judgement

Seeing as Communicado have so far ignored the claim filed against them I've just requested judgement by default.
This could take a few weeks, but it's now in the hands of the county court system!

You must respond to this claim form within 14 days

So, after numerous spam emails, Communicado Ltd have said they won't pay damages and that I will lose any claim I make.
Interestingly, their last email seems to have given up the pretence that it's legal, but that it will be thrown out as my claim amount (a paltry £10 per email) is not justifiable.

Communicado have replied once again, with the detaile of their list broker:

We have also suppressed the domain @jane.earlsoft.co.uk. The source for this address would seem to be Marketing Webs who supply business addresses and are DMA members.
